This website (“Site”) is a brief introduction to Fields™, a rising community in Frisco, Texas, under development by FHQ Development Partners LP (“Developer”).  The website is not intended to be a comprehensive source of information, but rather to provide general information. Any statements about or description of proposed plans are subject to change or cancellation (in whole or in part) at any time without notice. Land uses, public and private facilities, improvements, and plans described or depicted herein may in some cases be conceptual and therefore subject to government approvals and market factors, which may alter the ultimate outcome. Photographs and renderings of private homes, amenities, or facilities contained in this Site may be representative only and not located within Fields™ . Neither this Site, nor the information and materials described herein, nor any communication made or given in connection with any of the foregoing, may be deemed to constitute any representation or warranty nor otherwise be relied upon by any person or entity.

 

Access to and use of the recreational facilities and amenities described herein is not included in the purchase of property and does not constitute an offer to sell real estate. The right to access and use public or private facilities identified on this Site, including, but not limited to, the facilities of the Professional Golfers’ Association of America or any residential neighborhood or any other amenity within Fields™ may be subject to the payment of additional fees and such additional terms and conditions as may be established by the owner of such facilities.

 

For convenience, Developer may provide links to other websites. Moreover, links to this Site may be provided from other sites with or without Developer’s knowledge. Developer is not responsible for the content or privacy practices of any site that is linked to or from this Site, except for those sites identified by Developer as Developer-affiliated companies whose sites are under the direct and sole control of Developer. Developer will promptly remove any link from this Site upon request from the linked entity.

 

The trademarks, service marks, logos, and trade names (“Trademarks”) and photographs, artwork, artists renderings and other similar Site content (“Copyright Material”) displayed on the Site are owned by Developer or by a third party who has granted Developer the right to use them on the Site. Any use of a Trademark or Copyright Material displayed on this Site without the prior written consent of its owner is prohibited.

 

Personal Information

Developer and each of its affiliated companies are committed to respecting the privacy rights of visitors to Site. While you (“you” or “your”) are visiting the Site, we may ask you to provide information that personally identifies you (“Personal Information”) for the purposes of interacting with the Site or to allow you to submit additional information.

 

We will take measures so that the Personal Information you submit to us is used only for the purposes as set forth herein. To further the protection of your Personal Information, we have adopted a set of information management guidelines (outlined below) to describe the Personal Information we collect about you, why we collect it, how we use it, and when we share it with third parties.

 

Developer’s policies have been developed with the recognition that Internet technologies continue to evolve, and our business models and processes will evolve as well to work in concert with these changes. Accordingly, the policies are subject to change. Any changes will be posted on this page.

 

We collect only Personal Information that you submit to us, including but not limited to personal data (e.g., your name, mailing address, and email address), for example when you request further information or wish to submit certain information to us. You are not obligated to provide us with this information, although it may be necessary to fulfill your request or allow you to submit additional information. Additionally, we may collect aggregate information about users of the Site. Aggregate information includes data about usage of the Site including traffic patterns, number of Site visits and/or use of services on the Site. This information is not identifiable to individual Site users. We may share the information you provide with companies affiliated with us. We also may share information provided by our Site visitors with service providers we have retained to perform services on our behalf. These service providers are required to use or disclose the information only as necessary to perform services on our behalf or to comply with legal requirements. Also, we may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. We reserve the right to transfer any information we have about you if we sell or transfer all or a portion of our business or assets. Also, we may share aggregate, non-personally identifiable information with our business partners and other affiliated third parties (e.g., the number of users who have visited the Site on a specific day, etc.). We may also match aggregated user information with third-party data and disclose aggregated user statistics to describe our services to potential advertisers, partners, and other third parties and for other lawful purposes. By submitting Personal Information, you grant permission to the Site for use consistent with Developer’s policies. Consent will be assumed unless otherwise stated by you at the time of submission.

 

We do not specifically collect information about children but are concerned about the safety of children and their use of the Internet. Therefore, in accordance with the Children’s Online Privacy Protection Act of 1998, we will not knowingly request or solicit personally identifiable information from anyone under the age of 13 without prior verifiable parental consent. If we receive actual knowledge that we have collected such Personal Information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. The Site is not intended for use by persons under the age of 13 without parental consent.

 

We contract with one or more third parties to maintain and host the Site. Therefore, any information you submit, including Personal Information, may be placed and stored on a computer server maintained by a third party. Your use of the Site and any provision of Personal Information you submit to the Site constitutes your acknowledgment that such information or content could pass through and may be stored in servers outside our control. You agree that we have no liability or responsibility for any such pass-through or storage of same.

 

The exclusive jurisdiction and venue for any claims arising out of or related to these Developer’s policies or your use of this Site will lie in the state or federal courts located in Dallas County, Texas, and you irrevocably agree to submit to the jurisdiction of such courts. The failure of Developer to enforce any right or provision herein will not constitute a waiver of such right or provision unless acknowledged and agreed to by Developer in writing. If a court of competent jurisdiction finds any provision of these policies to be illegal, invalid, or unenforceable, the remaining portions will remain in full force and effect.
